Orbit Dialer Terms

The additional terms that apply when your workspace uses the Dialer: phone numbers, outbound calling, recordings, transcripts, AI call feedback and billing.

Effective October 26, 2026 · Version 2026-10-26

These terms are provided for the Orbit Dialer. They are not legal advice. Telemarketing, do-not-call and call-recording laws differ by country, state and province and change often; consult your own counsel about the obligations that apply to your calls.

1. Scope

These Orbit Dialer Terms ("Dialer Terms") supplement the OrbitForms Terms of Service and apply whenever your workspace uses the Dialer (the "Dialer"), which is part of every OrbitForms plan. That includes the phone numbers provisioned through it, outbound calls and calling minutes, call recordings, call transcripts, AI call feedback, answering-machine detection, call scripts and pre-recorded voicemail messages ("voicemail drops"). If these Dialer Terms conflict with the Terms of Service, the Dialer Terms control for the Dialer only.

2. Eligibility and acceptance

A workspace administrator accepts these Dialer Terms on behalf of the workspace and every person who dials from it when the workspace buys its first phone number. By accepting these Dialer Terms you confirm that you are authorized to bind the workspace, that the workspace has an active OrbitForms plan with a valid payment method, and that the workspace's use of the Dialer will comply with these Dialer Terms. We record who accepted, when, and which version of these terms was accepted.

3. Fees and billing

The Dialer

The Dialer is included in your OrbitForms plan at no additional subscription fee. You pay for the phone numbers your workspace rents and for the calling and transcription minutes it uses, as set out below.

Phone numbers

Each local number costs $5 per month and each toll-free number $10 per month. Your first number is charged in full when you buy it and starts the workspace's monthly Dialer billing period, which renews on the same day each month for as long as the workspace holds at least one number. A number added part-way through a billing period is charged immediately for the remainder of that period on a prorated basis. When you release a number, the unused part of the period is credited against your next invoice.

Calling minutes

Outbound calls that are answered are billed at $0.02 per minute, with each call rounded up to the next whole minute. Unanswered calls, busy signals and failed calls are not billed.

Call transcripts

Where transcription is turned on, each transcribed call is billed at $0.05 per minute of transcribed audio, rounded up to the next whole minute. This fee covers transcription only. Section 8 explains which calls are transcribed.

AI call feedback

AI call feedback is not covered by the per-minute fees. Each call the AI coach reviews uses 1 AI credit from the workspace's plan AI credits, the same credits your AI agents use. Where your plan includes AI credits, feedback draws on them, and a workspace administrator can turn on on-demand credits from the Billing page. When the workspace has no credits left, feedback is skipped for that call and nothing is charged.

How you are charged

Dialer charges are billed to the payment method on file for your OrbitForms subscription through a separate monthly Dialer invoice. Calling minutes and transcribed minutes are billed in arrears: they accrue during a period and appear on the following monthly Dialer invoice. Prices exclude applicable taxes, which are added where required. The workspace is responsible for all charges incurred through it, including charges that result from unauthorized use of its users' credentials. We may change Dialer prices with at least 30 days' notice; a change takes effect at your next renewal after the notice period. If a payment fails we will retry it and notify you; we may suspend dialing or release your numbers if the balance remains unpaid.

4. Releasing numbers and stopping

A workspace administrator can release any phone number at any time from Dialer settings or the Billing page. A released number stops working immediately, the unused part of its billing period is credited against your next invoice, and the carrier may reassign the number to someone else. Releasing all of your numbers ends the monthly number charges; calling and transcription minutes used before then are billed on the following invoice. Fees already charged for a billing period are not otherwise refunded. If the Dialer subscription ends because payment could not be collected, every number the workspace holds is released.

5. Phone numbers

The Dialer currently offers phone numbers in the United States. Numbers are subject to carrier and regulatory eligibility, and we may ask for business, identity or address information before provisioning a number where a carrier or regulator requires it.

Phone numbers are provisioned on OrbitForms' carrier account and are licensed to your workspace for as long as the workspace rents them; they are not sold to you. Numbers are released when you release them or when the Dialer subscription ends for non-payment, and a released number may be reassigned by the carrier. You may ask us in writing to port a number to another provider; porting is subject to carrier rules and timelines and may not be possible for every number.

Calls display the number assigned to the calling person, or the workspace's default number. You must not configure or use any number to display misleading caller identification, and you are responsible for keeping the caller identity accurate under the Truth in Caller ID Act and similar laws.

6. Lawful calling and compliance

You are solely responsible for ensuring that every call placed through the Dialer complies with the laws that apply to you and to the people you call. In the United States that includes the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), state telemarketing and "mini-TCPA" laws, and the National Do Not Call Registry. Calling-hour restrictions vary by state.

You must obtain any consent the law requires before calling, scrub your lists against the government registries that apply to you, honor every opt-out request promptly, and maintain your own internal do-not-call list. The Dialer's do-not-call list automatically adds phone numbers from email unsubscribes and SMS opt-outs recorded in Orbit and never dials them. It is a tool that helps you honor requests; it does not replace your obligations and does not check any government registry on your behalf.

The Dialer only places calls to numbers in the United States; numbers in other countries are left out of call lists. We may block calls to any destination or number at any time. You must not call emergency, premium-rate or otherwise prohibited numbers, and you must not use the Dialer for debt collection, political, charitable or healthcare calling where additional rules apply unless you comply with those rules.

7. How the Dialer places calls

The Dialer is a single-line power dialer. It places one call at a time from the signed-in person's web browser. The next number in a list is dialed only after the previous call has ended, only while that person's Dialer session is open in their browser, and either when the person chooses or automatically after a short pause that the person sets and can turn off. The person can pause or stop at any time, and dialing stops when the browser is closed. The Dialer never dials more than one number at once, never predicts when a person will be available, and never places a call without an open session.

OrbitForms' AI features, MCP tools and public API can configure the Dialer, build call lists and read results. They cannot place calls, start a dialing session or obtain calling credentials. You must not use the Dialer, or any automation around it, to deliver unsolicited automated or prerecorded calls where the law requires consent for them.

A voicemail drop plays a pre-recorded greeting only on a call the person placed that reached voicemail: either when the person chooses to on that call, or, when the workspace turns on automatic drops, only after answering-machine detection reports voicemail. Voicemail drops remain subject to the consent and disclosure laws that apply to prerecorded messages, including identifying who is calling and how to opt out where required.

8. Call recording, transcripts and AI feedback

Recording

Call recording is turned on by default for the workspace. A workspace administrator can turn it off in Dialer settings. Where recording is on, you are responsible for giving any notice and obtaining any consent that applies, including in jurisdictions that require the consent of every party to the call. Dialer settings include a recording announcement that, when turned on, tells the called party that the call may be recorded when they answer and before they are connected. The announcement helps with all-party-consent laws but does not replace your own notice and consent obligations. Recordings are stored by our carrier on OrbitForms' account and are streamed to members of your workspace through Orbit.

Transcripts

Where transcription is turned on, we transcribe only recorded calls that were answered by a person. Transcription requires answering-machine detection to be on. Calls that answering-machine detection reports as voicemail or fax, calls where a voicemail was dropped, and very short recordings are not transcribed. Detection is not perfect, so a voicemail may occasionally be transcribed and billed as a transcribed call. Transcripts are produced by our carrier's transcription service and are available to members of your workspace.

AI call feedback

Where AI call feedback is turned on, the transcript of each transcribed call is sent to our AI provider, which writes feedback for the person who made the call. The feedback is generated automatically and may be incomplete or wrong. It is a coaching aid, not a record of what was said.

9. No emergency calling

The Dialer cannot call 911 or any other emergency service.

Calls are placed from a web browser over the internet, and the phone numbers provisioned through the Dialer do not support emergency calling, location routing or callback. We show this notice inside the product as well. You must keep a traditional telephone line or mobile phone available for emergencies, and you must tell every person who uses the Dialer that it cannot reach emergency services. OrbitForms is not liable for any failure to connect an emergency call through the Dialer.

10. Acceptable use

You must not use the Dialer to harass, threaten, defraud or deceive anyone; to spoof or disguise the origin of a call; to impersonate a person or organization; to collect information under false pretenses; or to generate call volumes or patterns that violate carrier rules or lead to carrier complaints. We may suspend dialing, release numbers or end the workspace's access to the Dialer for abuse, carrier or regulatory complaints, or non-payment, with notice where practical.

11. Data

Call recordings, transcripts, AI feedback, voicemail greetings, call scripts, call outcomes, notes and call metadata are customer data processed under the OrbitForms Data Processing Addendum. Twilio (telephony and transcription) and Anthropic (AI call feedback) act as subprocessors for the Dialer and are listed on our subprocessors page.

A workspace administrator can delete a call's recording and transcript from the call's details or through the API. Deletion removes the audio and the transcript at the carrier and the transcription service; only the call's metadata (time, number, outcome and notes) is kept. Otherwise we keep Dialer data for as long as your workspace keeps it. When your workspace closes, or on your written request, we delete Dialer recordings and transcripts on the timeline in Section 12 of the Data Processing Addendum, subject to legal holds. Copies in backups expire on the normal backup cycle described there.

12. Disclaimers and limitation of liability

Calling depends on third-party carriers and the public telephone network. We do not guarantee that any call will connect or that call quality will meet a particular standard. Carriers and call-analytics providers may label calls as "Spam Likely" or block them, and your answer rates depend on them; that is outside our control. Answering-machine detection and transcription are automated and are not always accurate, and AI feedback may be incomplete or wrong.

OrbitForms is not a telecommunications carrier, and the Dialer is not a replacement for a telephone service. The Dialer is provided "as is" to the extent permitted by law, and the limitations of liability in the Terms of Service apply to it.

13. Indemnification

You will defend and indemnify OrbitForms and its affiliates against claims, fines, penalties and costs arising from calls placed through your workspace, including claims under telemarketing, do-not-call, caller-identification and call-recording laws, and from any breach of these Dialer Terms by you or the people who dial from your workspace.

14. Changes to these terms

We may update these Dialer Terms. A new version is identified by its version string, is posted on this page with its effective date, and must be accepted before a workspace buys its first phone number. For workspaces that already use the Dialer we will give notice of material changes; continued use after the effective date means you accept the new version.
